Petition for Alley/Street Vacation/Abandonment Procedures

 

  1. City Clerk's Office has the forms residents will need to file for an Alley Vacation or Abandonment.
  2. The City Assessor will help the resident with the legal description and tell you how many signatures you will need.
  3. The resident will then take the petition to adjoining neighbors (commercial and/or residential) who have no objection to the petition and sign.
  4. When all signatures are collected, return the petition to the City Clerk's office for City Council Action, which is a Public Hearing.
  5. The City Council, at their next meeting, will authorize the City Clerk to publish the Notice of Public Hearing in the City's official newspaper. Copies of said notice are sent to the Administration, Department of Public Works, Ameritech, Detroit Edison, Detroit Water, Michcon, and Wayne County Road Commission.
  6. After notice is given a public hearing is held in Council Chambers which the applicant will be requested to attend.
  7. Two weeks later on the next Council Agenda Council makes a determination to approve or deny the request.
  8. If Council vacates/abandons the alley/street the Council Motion approving the vacation/abandonment is filed with the Register of Deeds for recording.
  9. The recorded document, when returned from the Register of Deeds, will be sent to the Department of Public Works, Assessor, Wade-Trim/Associates (engineers) and Brandon Rodgers (planning consultant). Also a copy is sent to the Department of Treasury, Bureau of Local Property Services.
